FAMILY MEDIATION SERVICE
Our website is currently undergoing a re-design to make it easier for those considering or facing separation or divorce, to better understand why mediation is important, the benefits it delivers and how the process works.
So, while we work behind the scenes, the following will explain a little of what we offer, but please get in touch, if you’d like to know more.
What is Mediation?
Mediation is a private and voluntary method of resolving disputes during separation or divorce. A trained impartial professional Mediator from Buckles Law, will meet with both parties individually, and then together, in a safe neutral environment.
These meetings will explore ways of reaching agreement on those most important aspects of the marriage breakdown, involving Child Arrangement Programmes, distributing property and pensions, and allocating maintenance.
What are the benefits?
This process is often quicker, less expensive and less stressful than going to Court. Together you remain in control of discussing practical issues that concern your individual family’s needs and priorities. Separating parents can keep the needs of the children forefront of the discussions and look to the future for a positive outcome. This process can avoid the negative impact of Court litigation, as you will find that you start to work together to achieve an amicable outcome.
Who are the Mediators?
Lyn Brisley and Sonia Rola are both very experienced Resolution trained Mediators, who are devoted to resolving family disputes in the most constructive manner. Both mediators are very experienced family lawyers with expert knowledge of the Family Court’s expectation.
In their role as Mediator they do not give legal advice, but provide legal and financial information to help you come to your own decisions. Our Mediators are very aware of the need for complete transparency between clients so that agreements reached are fair with an absolute sharing of all knowledge. They will then provide a Memorandum of Understanding to summarise proposals made through Mediation.
Do I need a lawyer?
If mediating through Buckles’ solicitors, you can engage your own lawyer who will provide legal advice in between Mediation sessions and/or at the end of the process. At that point, concluded agreements are created by your lawyer and once approved by the Court, they become legally binding.
What does it cost?
The main Mediation sessions after the initial MIAMS generally last between one and a half to two hours, and are charged by the hour. The number of sessions will depend upon how quickly you can reach an agreement.
Fees are often split between the clients or a funding source to pay for the process is identified during Mediation. Please note, we do not provide Mediation for those seeking Legal Aid or a voucher system.
